TERMS

By ordering a product from RoseWolf Design (RWD for short), you are agreeing that you have read, and agree to, the following terms. If anything seems unclear, please don’t hesitate to contact me.

 

Payment

 

Payment is via Paypal/Bank Transfer (Paypal does incur a transaction fee of 3.4% + £0.20p per transaction, which will be stated if you prefer to pay via Paypal). An invoice from RWD will be sent to a client's email address prior to release of products, products will only be released once payment has been received in full.  

 

A deposit of 50% is required before commencement of work with the exception of pre-made covers which must be paid for in full prior to work commencing on adjusting a pre-made for a client. Pre-made covers are only sold once.

 

The client agrees to pay promptly – within five days of invoice date - for their project/order.

 

Cover Files provided - For ebooks a high-resolution JPEG file is provided for the client to use for their ebook. The following sizes will be provided (in pixels): 3200 x 4800 (for poster printing if needed), 1700 x 2500, and 1600 x 2400 (which should work for all book sites, although KDP prefer the long side to be 2500). A small image will also be provided for promotional purposes. If a different size is required the client can request this when ordering.

 

For paperback cover design the client is purchasing a designed cover laid out to fit either Createspace, Ingram Spark, or Clays in print ready CMYK PDF format. If the client wishes to purchase a print ready paperback cover for more than one template/printer there will be an additional cost. If the client wishes to use a printer other than those mentioned above RWD will require the client to provide a template.

 

For banners/headers/promotional material the files are provided to the client in JPEG format or PDF (whichever is requested).

 

Stock Images - To make a design for the client, RWD will purchase stock images to use in the project. The client cannot use the purchased images in any other way, only as part of the final design (ie: as used in the book cover). If the client wishes to purchase the same images used for their own use, RWD can provide details of where to find the images.

 

The paperback/ebook cover design process

 

  1. Create mock-ups based on the client’s design brief (RWD will create front cover/ebook cover mock-ups to the total of 5 concepts/ideas – for paperback covers once the front has been agreed the full wrap will be worked on)

  2. The client picks one mock-up to work further on*,

  3. The mock-up is worked upon and the client can request reasonable alterations**,

  4. After the chosen mock-up is approved, RWD will work on the final idea,

  5. Once the final is created a proof and invoice for the complete project will be sent to the client to approve,

  6. The client approves the proof and pays the invoice (by approving the proof the client agrees they are satisfied with the project as it is),

  7. After the invoice payment has been received RWD will send the completed book cover/ebook cover to the client either via email or, if the files are too large for email transfer, via WeTransfer (a free file transfer service).

 

*Once a mock-up has been chosen the other mock-ups are no longer available for consideration, if the client wishes to use one of the other mock-ups once work has commenced on the first chosen mock-up there will be additional costs.

**The client can request alterations to ONE concept/design mock-up to work on. Reasonable alterations can be requested to the selected mock-up (by reasonable RWD means: tweaking elements of the cover: moving things. change of colour, change of font/font colour, alterations to the stock image(s) already purchased or if changes are within the original design brief given by the client – if changes mean a completely new cover design then this is not considered a reasonable change and will incur an additional cost to be agreed.)

 

The promotional/banner/header/extras design process

 

  1. Create mock-ups based on the client’s design brief (up to 3 concepts/ideas – more will incur an additional fee),

  2. The client picks one mock-up to work further on*,

  3. After the chosen mock-up is approved, RWD will work on the final,

  4. Once the final is created a proof and invoice for the complete project will be sent to the client to approve,

  5. The client approves the proof and pays the invoice (by approving the proof the client agrees they are satisfied with the project as it is),

  6. After the invoice payment has been received RWD will send the completed JPG file via email or, if the files are too large for email transfer, via WeTransfer (a free file transfer service).

 

What RWD will need from the client & approval information

 

The client will need to fill out a design brief form and add any information they feel is relevant to their design.

 

For paperback covers the client will need to provide:

 

  1. The final page count of their interior print ready file once it is finalised,

  2. The final trim size,

  3. All of the text needed to put on the back of the cover,

  4. Which printer the client will be using,

  5. The colour of the paper for the interior – white or cream,

  6. The finish of the cover – matt or gloss,

  7. For any printer other than Ingram Spark, Createspace or Clays, the client will need to provide the template,

  8. The ISBN if printing with Ingram Spark or Clays.

 

These details are needed once the client knows the FINAL page count and trim size of their interior file as covers are sized to fit those specific measurements, if the client changes the details after work has begun on the paperback template there will be additional costs.

 

The client should credit any stock images as required by the stock image license.

 

By ordering any product from RWD the client agrees that RWD can use the final product for advertising/portfolio purposes. Client testimonials are welcomed and RWD is very happy to link back to the client’s own website alongside any testimonial etc.

 

Once a project has been paid for, the client is granted the exclusive license so they can use the final completed design artwork (be it a paperback, ebook cover, promotional/banner/header etc.). The client may not alter the design in any way without written consent from RWD, or unless the alterations are undertaken by RWD.

 

RWD will be the sole designer of any product ordered#.

 

(# excluding any promotional works undertaken which may include covers not designed by RWD, in this case RoseWolf holds no such agreement and does not claim any rights/ownership to such a cover as used for promotional purposes. If a client has a book published with a publishing company/or a cover designed by another designer, RWD can only work on promotional material which features the cover if permission is given for the cover image to be used in such a way for promotional purposes. RWD will not alter a previously designed cover in any way, including in promotional material.  If the cover is not permitted to be used in this way RWD can create graphics to suit the feel and tone of a client's book without using the cover image. If a client designed their own cover and holds the necessary rights RWD can create promotional graphics including the cover). 

Bespoke work

Pricing upon request, per project, details of files etc., provided once project is known. A deposit (up to 50%) will be required before work commences, which will be fully refundable if the project is cancelled within 24hours of deposit being received by RWD.

 

- The client indemnifies and holds harmless RWD (Gina Dickerson) against any and all claims, demands, actions or the similar, arising from using any design products from this site/designer. This may include, but is not limited to, any images/covers for promotional purposes provided to RWD by the client which did not hold the correct permissions for use. 

 

Cancellation

 

If the client changes the original project brief, RWD reserves the right to cancel the project immediately.

 

If the client wants to cancel the project for a refund of what they have paid to date, they may do so if any of the following apply:

  1. Work has not begun on the project,

  2. Within 24hrs of payment being made (else work may have begun),

  3. They paid a 50% deposit or paid for the project in advance.

 

If the client has chosen a cover mock-up to work on as a final idea and then wishes to cancel the project the client agrees to forfeit the 50% deposit already paid.

 

If the client wishes to cancel the cover project after they have approved the final version of the project (proof stage), they agree to forfeit the complete 100% of the project fee.

 

If the client wishes to cancel the project (all non-cover projects) and has not paid in advance then the client agrees to the pay, a) the full fee if the work has been completed, or b) an hourly rate of £15.00 for time spent on the project.

 

If any project is cancelled at any stage by either the client or RWD, the client holds no claim, nor retains any rights, to any proofs/mock-ups /designs made by RWD and agrees not to use any such items in any way, at any time. Nor can the client use any mock-up not chosen at any time, nor display any mock-up at any time either online or in printed format.

 

Additional

 

RoseWolf Design will not share/pass on/give any client information or documents/material considered confidential with any third party. The information will only be used by RoseWolf Design to work on a client project.

 

All correspondence to and from RoseWolf Design will be via email.
